Employment Tribunals

What are employment tribunals?

Outsourced HR Support

An employment tribunal is a specialist legal body in the UK that resolves disputes between employers and employees over workplace rights. Unlike courts, tribunals are designed to be more accessible, but the outcomes are just as serious: decisions are legally binding and published online for the public to see.

Employees can bring tribunal claims for a wide range of issues, including…

  • Unfair dismissal
    • Where the employee believes the reason or process for dismissal was not fair or lawful.
  • Discrimination
    • Claims based on protected characteristics such as age, disability, race, sex, religion or belief, or sexual orientation.
  • Redundancy disputes
    • Including unfair selection or failure to follow proper consultation.
  • Unpaid wages and holiday pay
    • Including unlawful deductions or incorrect calculations.
  • Breach of contract
    • For example, failure to provide notice pay.
  • Whistleblowing
    • Where an employee alleges unfair treatment for raising public interest concerns.

A tribunal hearing involves presenting evidence, witness statements, and legal arguments before a panel, usually an employment judge, and in some cases, lay members. The tribunal can award compensation, order reinstatement or re-engagement, and in some circumstances issue recommendations to change workplace practices.

Even if an employer believes they have done everything correctly, defending a tribunal claim can be complex, time-consuming, and costly.

Why do employment tribunals matter to your business?

Employment tribunals have far-reaching consequences for employers.

They matter because they…

  • Carry financial risk
    • Tribunal awards can be significant. For example, in discrimination cases compensation is uncapped, meaning the costs can run into six figures once legal fees and management time are factored in.
  • Damage your reputation
    • Tribunal decisions are published online, meaning anyone (including staff, customers, and competitors) can see the outcome. Negative publicity can affect your brand and your ability to attract and retain talent.
  • Disrupt operations
    • Investigating claims, preparing evidence, and attending hearings takes time away from running the business and can involve senior managers and HR teams for weeks or months.
  • Affect employee morale
    • Tribunal cases can cause anxiety and tension across the workforce, particularly if colleagues are called as witnesses.
  • Expose compliance gaps
    • A claim often highlights weaknesses in policies, procedures, or management practices that need urgent attention.

Even if your business successfully defends the case, the process itself can be stressful and expensive. That’s why the best approach is to reduce the risk of claims through strong HR practices and early intervention.
