Unfair Dismissal Claims

What is unfair dismissal?

Under UK employment law, employees with at least two years’ continuous service are generally protected from being unfairly dismissed.

This means that an employer must have a fair reason for ending someone’s employment and must follow a reasonable process.

Fair reasons for dismissal may include…

  • Misconduct, such as breach of company rules or inappropriate behaviour
  • Capability, such as performance or health-related issues affecting the role
  • Redundancy, where the role is genuinely no longer required
  • Statutory restriction, such as loss of a licence needed for the job
  • “Some other substantial reason”, such as a business reorganisation or breakdown of trust

If an employee believes they have been dismissed without a fair reason, or that the process was flawed, they can bring a claim to an employment tribunal. Tribunals can award significant compensation and order reinstatement, making it vital for businesses to manage dismissals correctly from the start.

What is automatically unfair dismissal?

Even if an employer has acted reasonably, some reasons for dismissal are classed automatically unfair, namely…

  • pregnancy, including all reasons relating to maternity
  • family, including parental leave, paternity leave for birth or adoption, adoption leave, or time off for dependants
  • acting as an employee representative
  • acting as a trade union representative
  • acting as an occupational pension scheme trustee
  • joining or not joining a trade union
  • being a part-time or fixed-term employee
  • pay and working hours, including the Working Time Regulations, annual leave, and the National Minimum Wage
  • reporting certain types of wrongdoing, known as whistleblowing

Unlike ordinary unfair dismissal, there is no two year qualifying period necessary for an employee to make an automatically unfair dismissal claim.
